Shockingly, President Biden said, “The Jury system works, and we have to abide by the decision” “I stand by what the jury has concluded,” in response to the grossly racist verdict in the trial of white vigilante Kyle Rittenhouse. Our response: No, our Movement does not accept the decision to let a fascist murderer walk free! No Jim Crow white-majority-jury and openly racist judge or anybody can convince millions of people in America and around the world that Kyle Rittenhouse is anything other than a racist murderer.
November 19th, 2021 must be a clear reminder that only our Movement fighting in the streets, like we did in the fight for justice for George Floyd and to jail racist cop Derek Chauvin, can win justice against racism. We cannot rely on the courts and a legal system built historically to deny the basic human rights of minorities in America in order to defend white privilege and racist inequality.
This verdict is the racist conclusion of a racist process. From beginning to end, and through national television, a New Jim Crow trial unfolded for all to see. A process, which for us, the majority of black and Latina/o communities, are much too familiar with; a blatant exercise of the use of the law to defend racist violence and murder. A trial reminiscent of the old Jim Crow system in the south perfected in the courts to uphold second class treatment of black people, and brutally enforced through violent white lynch mob terror.
From judge Bruce Schroeder shamelessly defending Rittenhouse from the beginning by suppressing evidence of his ties to white supremacists and proud boys, dismissing black jurors over potential bias, skewing the trial in Rittenhouse favor by banning the use of the term “victims” for protestors, but allowing peaceful protestors to be called “rioters,” and “the mob,” to dropping the charge of “illegal possession of a dangerous weapon” and even making a racist joke against Asians. Schroeder made sure the jury knew what side he was on, the side of racism. There is not much to be said of a prosecutor who refuses to address the question of racism in a trial about a racist murderer and claims after the trial that “The jury represents the people of Kenosha and we must respect their decision.”
In this trial, it was clear that, especially now in the era of Trump, for a racist murderer to walk free, they need only to perform a badly rehearsed act of a choir boy shedding crocodile tears in front of a white majority jury. Meanwhile the judge and a flaming racist defense lawyer openly appeal to the racist paranoias of white people and their self-entitled need to defend their white privilege against imaginary rabid mobs of black protestors.
After witnessing such a scandal, to take the advice President Biden, would mean to close our eyes to the truth and give a green light to individual racists and fascists, and paramilitary groups to arm themselves to become white vigilantes attacking and targeting to kill any black, Latina/o, minority and or anti-racist white protestors in any city in America. Biden wants us to forget about the old Jim Crow system of juries in the South that would never find a white man guilty of a crime against any black citizen and would never recognize the innocence of a falsely accused black man. To accept Biden’s advice, would be to accept the New Jim Crow in America and to allow the conditions for another Trump supporting fascist coup at the Capitol in DC. To accept the New Jim Crow would mean giving up any hope to win justice for Ahmaud Arbery in the now ongoing trial in Georgia. Simply put, in order to stop the epidemic of racist police murders in America, to end racial inequality, to win citizenship rights for immigrants, to fight for equal rights for LGBTQ people, to win free healthcare for all, to solve the climate crisis, etc…, our Movement must not accept Biden or anyone calling for accepting this racist decision and giving up on our fight for real justice and equality.
The challenge in front of us is not to reach across the aisle or turn the other cheek for political posturing. Our challenge is to act now to defeat the rise of a potential fascist movement in America and for our integrated Movement to pave the way to real equality and justice. The kind of equality and justice that is not found in the laws, the courts, white savior presidents and their Party or the heavens, but that kind found by Frederick Douglass, Harriet Tubman and the abolitionist Movement, by Martin Luther King and the Civil Rights Movement, and won out of hard fought, independent, mass militant struggles of the oppressed in the streets.
With the fiery spirit of Ferguson and the fights for Justice for Mike Brown, for Oscar Grant, for Malice Greene, for Breonna Taylor, for Andres Guardado, for Sandra Bland, for Tamir Rice, for Ahmaud Arbery, for George Floyd, and every other black, Latino/a, Asian, Native American and or minority gunned down by racist murderers, OUR MOVEMENT MUST RETURN TO THE STREETS!

Sorprendentemente, el Presidente Biden dijo, “El sistema de jurados trabaja, y tenemos que acatar la decisión,” “Estoy de acuerdo con lo que el jurado ha concluido,” en respuesta al veredicto groseramente racista en el juicio del vigilante blanco Kyle Rittenhouse. Nuestra respuesta: ¡No, nuestro Movimiento no acepta la decisión de dejar a un fascista asesino caminar libre!
Ningún Jurado Jim Crow mayoritariamente blanco y un juez abiertamente racista o nadie puede convencer a millones de personas en Estados Unidos y alrededor del mundo que Kyle Rittenhouse es cualquier cosa más que un matón racista.
El 19 de noviembre de 2021 debe ser un recordatorio claro que solamente nuestro Movimiento luchando en las calles, como lo hicimos en la lucha por justicia para George Floyd y para encarcelar al policía racista Derek Chauvin, puede ganar justicia en contra del racismo. Nosotros no podemos confiar en las cortes y un sistema legal históricamente construido para negar los derechos humanos básicos de las minorías en los Estados Unidos a fin de defender el privilegio blanco y la desigualdad racista.
Este veredicto racista es la conclusión de un proceso racista. De comienzo a fin, y a través de televisión nacional, un juicio del Nuevo Jim Crow se desplegaba a vista de todos. Un proceso que, para nosotros, la mayoría de las comunidades Afroamericanas y Latina/os, con el que estamos demasiadamente familiarizados; Un ejercicio descarado del uso de la ley para defender el asesinato y la violencia racista. Un Juicio que hace recordar el viejo sistema de Jim Crow en el Sur perfeccionado en las cortes para defender el tratamiento de segunda clase de la gente Afroamericana, y brutalmente reforzada a través del terror de pandillas violentas blancas del linchamiento.
Desde el juez Bruce Schroeder descaradamente defendiendo a Rittenhouse y el comienzo al suprimir evidencia de sus conexiones a supremacistas blancos y proud boys (pandilla de fascistas pro Trump), descartando posibles jurados Afroamericanos por posible parcialidad, inclinando el juicio a favor de Rittenhouse al suspender el uso del termino “victimas” para protestantes, pero permitiendo el uso del termino “revoltosos” y “pandillas,” hasta el abandono del cargo de “posesión ilegal de una arma peligrosa” y hasta el hecho de hacer una broma racista en contra de Asiáticos. Schroeder se aseguro que el jurado supiera de que lado estaba él, del lado del racismo. No hay mucho que decir de un procurador que se rehúsa a abordar la cuestión del racismo en un juicio acerca de un asesino racista y dice después del juicio que, “El jurado representa la gente de Kenosha y debemos respetar su decisión.”
En este juicio fue claro que, especialmente ahora en la era de Trump, para que un asesino racista pueda caminar libre, solo tienen que actuar un acto malamente ensayado de un niño del coro llorando lágrimas de cocodrilo en frente de un jurado mayoritariamente blanco. Mientras que el juez y un flameante racista apelan a las paranoias racistas de gente blanca y su necesidad auto-autorizada para defender su privilegio blanco en contra de pandillas rabiosas imaginarias de protestantes Afroamericanos.
Después de ser testigos de tal escándalo, tomar el consejo del Presidente Biden, significaría cerrar nuestros ojos a la verdad y darle luz verde a individuos racistas y fascistas, y grupos paramilitares para armarse y convertirse en vigilantes blancos atacando y apuntando para matar a cualquier protestante Afroamericano, Latina/o, minorías y o anti-racistas blancos en cualquier ciudad en Estados Unidos.
Biden quiere que nos olvidemos del viejo sistema de Jim Crow de jurados en el Sur que nunca encontraban culpable a un hombre blanco de un crimen en contra de un ciudadano Afroamericano y nunca reconocían la inocencia de un hombre Afroamericano falsamente acusado. Aceptar el consejo de Biden seria aceptar el Nuevo Jim Crow en Estados Unidos y permitir las condiciones para otro golpe de fascistas pro-Trump en el Capitolio en Washington D.C. Aceptar el Nuevo Jim Crow significaría abandonar cualquier esperanza de justicia para Ahmaud Arbery en el juicio que se lleva a cabo ahora en Georgia. Simplemente dicho, para parar la epidemia de asesinatos racistas policiales en Estados Unidos, para acabar con la desigualdad racial, para ganar derechos de ciudadanía para inmigrantes, para luchar para los derechos de igualdad de la gente LGBTQ, para ganar atención médica gratuita para todos, para resolver la crisis climática, etc… nuestro Movimiento no debe aceptar el llamado de Biden o cualquier persona que esté aconsejando aceptar esta decisión racista y dar por vencida nuestra lucha por la justicia e igualdad real.
El desafío frente a nosotros no es extender la mano al otro lado o dar la otra mejía por pura postura política. Nuestro desafío es poder actuar ahora para derrotar el surgimiento de un movimiento potencialmente fascista en Estados Unidos y que nuestro Movimiento integrado pueda encaminarnos hacia la justicia e igualdad real. El tipo de igualdad y justicia que no se encuentra en las leyes, las cortes, presidentes blancos salvadores y sus Partidos políticos, o en los cielos. Mas bien, el tipo de justicia e igualdad encontrado por Frederick Douglass, Harriet Tubman y el Movimiento de abolición de la esclavitud, por Martin Luther King Jr. Y el Movimiento de Derechos Civiles, y ganado de luchas duras, independientes, militantes de masas de los oprimidos luchando en las calles.
Con el espíritu feroz de Ferguson y las luchas por la justicia para Mike Brown, para Oscar Grant, para Malice Greene, para Breonna Taylor, para Andres Guardado, para Sandra Bland, para Tamir Rice, para Ahmaud Arbery, para George Floyd, y cada otro Afroamericano, Latina/o, Asiático, Nativo americano, y u otra minoría abatido a tiros por racistas asesinos, ¡NUESTRO MOVIMIENTO DEBE REGRESAR A LAS CALLES!
